TERMS & CONDITIONS OF PARTICIPATION
PLEASE READ CAREFULLY
These Terms & Conditions (“Terms”, “Terms & Conditions” or “Agreement”) govern participation in, nomination for, selection for, receipt of an Award, attendance at, and association with the Lok Maharashtra Creator Awards(“Awards”).
The Awards are organised by [LEGAL NAME OF ORGANISER] (“Organiser”).
By submitting the nomination form, clicking the applicable acceptance checkbox, accepting a nomination, accepting an Award, attending or participating in the Event, accepting any Sponsor deliverable, or otherwise participating in the Awards, the Participant confirms that the Participant has read, understood and agreed to these Terms.
These Terms constitute a binding agreement between the Participant and the Organiser, subject to applicable law.
1. DEFINITIONS
For the purposes of these Terms:
“Awards” means the Lok Maharashtra Creator Awards, including the current edition, all Award categories, nomination process, selection process, Event, publicity, promotional activities and associated activities.
“Organiser” means [LEGAL NAME OF ORGANISER], including its affiliates, group entities, successors, permitted assigns, employees, officers, representatives, agencies, contractors and authorised personnel.
“Participant” means any person who submits a nomination, is nominated, shortlisted, selected, invited, attends, appears at, participates in or otherwise associates with the Awards.
“Nominee” means a person nominated for an Award.
“Winner” means a person declared as a Winner by the Organiser.
“Event” means the Award ceremony and all related activities, including red-carpet activities, interviews, backstage activities, promotional activities, rehearsals, media interactions and associated functions.
“Sponsor” means any sponsor, brand, commercial partner, media partner, promotional partner or other organisation associated with the Awards.
“Deliverables” means promotional or other activities specifically communicated by the Organiser to a Participant, including Reels, Stories, posts, videos, photographs, Sponsor promotions, appearances, interviews, tags, mentions, hashtags or other promotional activities.
2. FREE PARTICIPATION AND AWARD
2.1 Participation in the Awards is free of charge unless expressly stated otherwise by the Organiser in writing.
2.2 The Organiser does not charge a Participant merely for submitting a nomination.
2.3 The Award itself is provided without an Award fee or purchase price.
2.4 Receipt of an Award does not create an entitlement to any monetary payment, appearance fee, talent fee, influencer fee, content-creation fee, commission, royalty, reimbursement or other financial consideration from the Organiser.
2.5 The Award is an honorary/recognition-based Award and does not constitute a contract of employment, agency, partnership, franchise, talent management or commercial representation.
3. ORGANISER’S EXCLUSIVE OWNERSHIP AND CONTROL
3.1 The Awards are an independently conceived and operated Award property of the Organiser.
3.2 The Organiser shall have exclusive control over the organisation, administration, branding, promotion, presentation, operation and commercial exploitation of the Awards, subject to applicable law.
3.3 The Organiser shall have sole discretion to determine:
a. Award categories;
b. eligibility requirements;
c. nominations;
d. shortlisting;
e. selection;
f. Winners;
g. special Awards;
h. honorary Awards;
i. category modifications;
j. Event format;
k. Event date;
l. Event venue;
m. Event programme;
n. trophy design;
o. Sponsors and partners;
p. media arrangements;
q. promotional activities;
r. Award presentation arrangements; and
s. other matters concerning the Awards.
3.4 No Participant obtains ownership or proprietary rights in the Awards merely by participating in or receiving an Award.
4. ORGANISER-DETERMINED SELECTION
4.1 The Awards shall be determined exclusively by the Organiser.
4.2 There shall be no Jury, independent judging panel or external decision-making body, unless the Organiser expressly announces otherwise.
4.3 The Organiser may consider such factors as it considers relevant to the applicable Category, including:
a. originality;
b. creativity;
c. content quality;
d. consistency;
e. audience engagement;
f. reach;
g. influence;
h. innovation;
i. contribution;
j. public presence;
k. community impact;
l. industry contribution;
m. campaign performance;
n. professional achievements; and
o. other relevant factors.
4.4 The Organiser is not required to disclose its internal assessment methodology, deliberations, internal records, comparative assessments or reasons for selecting or not selecting any particular Participant, except where required by applicable law.
5. FINALITY OF ORGANISER’S DECISION
5.1 The Organiser’s decision concerning eligibility, nomination, shortlisting, selection and declaration of Winner(s) shall be final and binding upon Participants, subject to rights and remedies that cannot lawfully be excluded.
5.2 No Participant shall have a contractual right to demand:
a. nomination;
b. shortlisting;
c. selection;
d. winning;
e. disclosure of another Participant’s assessment;
f. disclosure of confidential internal records; or
g. reconsideration of the Organiser’s decision.
5.3 Mere disagreement with the Organiser’s decision shall not create an entitlement to a change in the Award result.
5.4 The Organiser may correct an administrative error or withdraw an Award where material fraud, false information, manipulation, material ineligibility or other material misconduct is subsequently discovered, subject to applicable law.
6. NO GUARANTEE OF NOMINATION OR AWARD
6.1 Submission of a nomination does not guarantee:
a. nomination;
b. shortlisting;
c. finalist status;
d. Event invitation;
e. trophy;
f. Award; or
g. any commercial, professional or promotional benefit.
6.2 The Organiser may reject or discontinue any nomination where information is incomplete, inaccurate, misleading, unverifiable or inconsistent with the applicable Award requirements.
7. ACCURACY OF INFORMATION
7.1 Every Participant represents and warrants that all information submitted to the Organiser is true, accurate, complete and not misleading.
7.2 The Organiser may verify information through publicly available sources, social-media profiles, analytics, documents and other lawful sources.
7.3 False, fabricated, manipulated or materially misleading information may result in rejection, disqualification or withdrawal of an Award.
8. FAKE FOLLOWERS, ENGAGEMENT AND MANIPULATION
8.1 Participants shall not knowingly submit artificially inflated or manipulated statistics.
8.2 This includes:
a. purchased followers;
b. purchased likes;
c. purchased views;
d. bot-generated engagement;
e. fake accounts;
f. manipulated analytics;
g. fabricated screenshots;
h. fraudulent voting;
i. automated activity; or
j. other deliberate manipulation designed to misrepresent genuine audience activity.
8.3 The Organiser may take appropriate action where it reasonably determines that material information has been manipulated.
9. SPONSOR DELIVERABLES
9.1 The Award is provided to the Winner without an Award fee.
9.2 Certain Winners may, however, be required to undertake promotional deliverables for Sponsors associated with the Awards.
9.3 Such deliverables may include:
a. Instagram Reels;
b. Instagram Stories;
c. social-media posts;
d. YouTube videos;
e. YouTube Shorts;
f. photographs;
g. Sponsor mentions;
h. account tags;
i. hashtags;
j. product/service features;
k. promotional appearances;
l. testimonials;
m. interviews; or
n. other promotional activities communicated by the Organiser.
9.4 The Organiser shall communicate the applicable deliverables, platform, number of posts/videos, deadlines, tags, hashtags and other requirements to the relevant Winner.
9.5 Such communication may be made by email, WhatsApp, written communication or another official communication channel.
9.6 Once expressly accepted by the Winner, the applicable deliverable shall constitute a binding contractual commitment.
10. NO PAYMENT OR REMUNERATION BY ORGANISER
10.1 The Participant expressly acknowledges that the Organiser is not paying the Participant for receiving the Award.
10.2 Unless expressly agreed through a separate written agreement signed by the Organiser, the Organiser shall have no obligation to pay:
a. appearance fees;
b. talent fees;
c. influencer fees;
d. content-creation fees;
e. Reel charges;
f. Story charges;
g. posting charges;
h. travel expenses;
i. accommodation expenses;
j. food expenses;
k. production expenses;
l. transportation expenses;
m. commission;
n. royalty;
o. incentive;
p. performance fees; or
q. any other monetary compensation.
10.3 Acceptance of an Award shall not create an implied obligation upon the Organiser to make any future payment.
10.4 Any separate commercial arrangement with a Sponsor or third party shall be governed by a separate written agreement, if any.
11. ACCEPTANCE OF SPONSOR DELIVERABLES
11.1 Where an Award or Winner status is accompanied by a Sponsor deliverable, the Winner acknowledges that the deliverable forms part of the applicable contractual terms.
11.2 The Winner shall perform the accepted deliverable within the applicable deadline.
11.3 The Winner shall comply with reasonable instructions relating to:
a. timing;
b. format;
c. Sponsor tagging;
d. hashtags;
e. campaign messaging;
f. disclosure requirements; and
g. other reasonable technical requirements.
11.4 A required social-media deliverable shall not be deleted, archived, hidden or materially altered before the agreed period without written approval from the Organiser.
12. FAILURE TO PERFORM SPONSOR DELIVERABLES
12.1 Failure to perform an accepted Sponsor deliverable without prior written approval or a legally recognised justification shall constitute a breach of the applicable obligation.
12.2 Breach may include:
a. failure to publish;
b. failure to publish within the agreed period;
c. failure to tag the Sponsor;
d. failure to include required hashtags or disclosures;
e. publishing materially different content from what was agreed;
f. premature deletion or archiving;
g. refusal to make reasonable compliance corrections; or
h. failure to attend an expressly agreed promotional activity.
13. AGREED COMPENSATION OF ₹15,000
13.1 Where a Winner has expressly accepted a Sponsor deliverable and subsequently breaches that commitment without prior written approval or a legally recognised justification, the Organiser shall be entitled to claim ₹15,000 (Rupees Fifteen Thousand only) as agreed compensation for the relevant breach, subject to applicable law.
13.2 The parties acknowledge that the stipulated amount is intended to reasonably address losses and costs that may arise from non-performance, including Sponsor coordination, promotional planning, administrative expenditure, campaign disruption, replacement arrangements and related costs.
13.3 ₹15,000 is not an entry fee, Award fee or purchase price for the Award.
13.4 The amount becomes relevant only upon the applicable breach of an accepted Sponsor deliverable.
13.5 The stipulated amount does not permit or authorise deliberate non-performance.
13.6 The Organiser reserves all other rights and remedies available under applicable law, subject to applicable limitations on contractual damages.
14. CURE AND REMEDIES
14.1 Where appropriate, the Organiser may provide written notice requiring the Participant to cure a deliverable breach.
14.2 The Organiser may, subject to applicable law:
a. require completion of the deliverable;
b. require reasonable corrective action;
c. withdraw promotional privileges;
d. withdraw future promotional opportunities;
e. correct inaccurate public representations;
f. withdraw an Award where legally permissible and where the applicable breach is material; and/or
g. pursue other remedies available under law.
14.3 Nothing requires the Organiser to provide an opportunity to cure where the breach is incapable of cure or immediate action is reasonably necessary.
15. PHOTOGRAPHY, VIDEOGRAPHY AND PUBLICITY RIGHTS
15.1 The Event and related activities may be photographed, filmed, recorded and documented.
15.2 By participating in the Awards, the Participant grants the Organiser, to the extent permitted by law, the right to use the Participant’s:
a. name;
b. professional name;
c. photograph;
d. image;
e. likeness;
f. voice;
g. video;
h. interview;
i. statements;
j. biography;
k. social-media identity; and
l. Award-related appearance.
15.3 Such material may be used for:
a. marketing;
b. advertising;
c. publicity;
d. social media;
e. websites;
f. digital campaigns;
g. press releases;
h. newspapers;
i. magazines;
j. television;
k. OTT platforms;
l. YouTube;
m. digital platforms;
n. promotional videos;
o. Award programmes;
p. Event screens;
q. sponsor presentations;
r. brochures;
s. posters;
t. promotional creatives;
u. archives; and
v. other lawful Award-related purposes.
15.4 The Participant shall not be entitled to royalty, licence fee, residual or other payment for such authorised use unless expressly agreed in writing.
16. FUTURE MARKETING AND PROMOTIONAL USE
16.1 The Organiser may use photographs, videos, interviews, Award announcements and other material captured or created in connection with the current edition to promote:
a. the current edition;
b. future editions;
c. future Award ceremonies;
d. future nominations;
e. Award highlights;
f. previous Winners;
g. historical Award content; and
h. the Awards brand generally.
16.2 Previously captured material may be reused for future Award-related marketing without obtaining a fresh consent each time, within the scope of the rights granted under these Terms and applicable law.
16.3 Use of a Participant’s image in future promotional material shall not falsely imply participation in or winning of a future edition.
17. TEN-YEAR MEDIA RIGHTS
17.1 In relation to the current edition of the Awards, the Organiser shall hold and control the media and exploitation rights for a period of ten (10) years commencing from the date of the Event, subject to applicable law and third-party contractual arrangements.
17.2 During this period, the Organiser may record, reproduce, edit, publish, communicate, broadcast, rebroadcast, stream, distribute, exhibit, archive and otherwise exploit the Event and related content through lawful media.
17.3 Such media may include:
a. television;
b. satellite;
c. cable;
d. OTT;
e. websites;
f. mobile applications;
g. social media;
h. YouTube;
i. streaming platforms;
j. digital platforms;
k. radio;
l. print;
m. electronic media;
n. outdoor/digital displays;
o. future digital formats; and
p. other lawful media.
17.4 The Organiser may license, assign or otherwise commercially exploit these rights, in whole or in part, to broadcasters, OTT platforms, media houses, publishers, production houses, agencies, Sponsors and other authorised partners.
17.5 The Organiser may create highlights, excerpts, trailers, interviews, compilations, documentaries, Reels, short-form videos and other derivative material from the Event.
17.6 Archival retention of Event-related material may continue beyond the ten-year commercial media period where permitted by law.
18. OWNERSHIP OF AWARDS INTELLECTUAL PROPERTY
18.1 The Awards name, logo, branding, artwork, Event format, official graphics, official announcements, Event recordings created by or for the Organiser, promotional creatives and other Organiser-created material shall remain the property of the Organiser or its licensors, as applicable.
18.2 No Participant acquires ownership of such intellectual property by participating in or winning an Award.
18.3 No Participant may reproduce, commercially exploit, license or modify the Awards branding without prior written permission.
19. CONTENT SUBMITTED BY PARTICIPANTS
19.1 The Participant retains ownership of intellectual property in content submitted by the Participant, unless otherwise expressly agreed.
19.2 The Participant represents that it has all necessary rights and permissions to submit such material.
19.3 The Participant grants the Organiser a worldwide, royalty-free, non-exclusive, transferable and sublicensable licence, to the extent necessary for the Awards, to reproduce, display, publish, communicate, distribute, edit, adapt, excerpt and use submitted material for:
a. Award administration;
b. nomination announcements;
c. Winner announcements;
d. publicity;
e. marketing;
f. media;
g. social media;
h. promotional campaigns;
i. future Award promotion; and
j. archival purposes.
20. EVENT RECORDING AND THIRD-PARTY MEDIA
20.1 The Organiser may record the Event in whole or in part.
20.2 Recordings may include:
a. red-carpet appearances;
b. interviews;
c. backstage activities;
d. Award presentations;
e. acceptance speeches;
f. audience footage;
g. performances;
h. Sponsor integrations;
i. press interactions; and
j. other Event-related activities.
20.3 The Organiser may appoint broadcasters, photographers, videographers, production houses, OTT platforms, media houses and other partners.
20.4 Participants authorise the Organiser to provide such authorised partners with relevant material within the rights granted under these Terms.
21. TROPHIES AND AWARD ITEMS
21.1 The Organiser shall make reasonable efforts to provide the applicable trophy or Award item.
21.2 Trophy design, dimensions, material, packaging and appearance may vary.
21.3 If a trophy is unavailable at the Event because of manufacturing, production, supplier, transportation, venue or other operational circumstances, the Organiser may provide it subsequently.
21.4 The absence or delay of a physical trophy shall not invalidate the Award.
21.5 The Organiser may provide a replacement, repaired or substituted trophy where reasonably practicable.
22. TROPHY DAMAGE, LOSS OR DELAY IN TRANSPORTATION
22.1 Where a trophy, certificate, gift or Award item is transported through a courier, logistics provider, transportation company or other third party, the Organiser shall not be responsible for damage, breakage, loss or delay caused solely by such third party, except to the extent liability cannot legally be excluded.
22.2 Where reasonably practicable, the Organiser may arrange repair, replacement or re-issue.
22.3 The Participant shall not be entitled to consequential or indirect damages merely because an Award item is delayed, damaged or unavailable.
22.4 Once the Award item has been delivered and accepted by the Winner or the Winner’s authorised representative, responsibility for its safekeeping shall rest with the Winner.
23. EVENT CHANGES, DELAYS AND CANCELLATION
23.1 The Organiser may change, postpone, reschedule, relocate, modify, suspend or cancel the Event where reasonably necessary.
23.2 Circumstances may include:
a. venue issues;
b. governmental restrictions;
c. public safety;
d. weather;
e. natural disasters;
f. technical failure;
g. power failure;
h. transportation disruption;
i. security concerns;
j. public emergencies;
k. third-party failure;
l. force majeure;
m. production issues;
n. operational circumstances; or
o. other circumstances beyond the Organiser’s reasonable control.
23.3 The Organiser shall not be liable for travel expenses, accommodation expenses, business losses, opportunity losses, inconvenience or other consequential losses arising from such circumstances, except to the extent liability cannot lawfully be excluded.
24. FOOD BOXES, HAMPERS AND COMPLIMENTARY ITEMS
24.1 Any food box, hamper, gift, merchandise, complimentary item or other benefit provided at or in connection with the Event shall be strictly subject to availability and on a first-come, first-served basis, unless expressly stated otherwise.
24.2 Availability of such items is not guaranteed.
24.3 No Participant shall have a monetary or contractual claim merely because an item is unavailable.
24.4 The Organiser may substitute an item where reasonably necessary.
24.5 Food and other consumable items may be supplied by independent third parties and may be subject to their own terms, ingredients, expiry dates and limitations.
24.6 Participants are responsible for informing themselves of allergies, dietary restrictions and sensitivities.
24.7 To the maximum extent permitted by law, the Organiser shall not be responsible for reactions arising from third-party food products except to the extent liability cannot legally be excluded.
25. TRAVEL AND PERSONAL EXPENSES
25.1 Unless expressly confirmed in writing by the Organiser, Participants are responsible for their own:
a. travel;
b. local transportation;
c. accommodation;
d. parking;
e. meals;
f. fuel;
g. personal expenses; and
h. other expenses associated with participation.
25.2 Participation or winning does not create an entitlement to reimbursement.
26. PERSONAL PROPERTY
26.1 Participants are responsible for their personal belongings.
26.2 To the maximum extent permitted by law, the Organiser shall not be responsible for loss, theft or damage to mobile phones, cameras, jewellery, bags, documents, equipment, vehicles or other personal property brought to the Event.
27. THIRD-PARTY SERVICE PROVIDERS
27.1 The Organiser may use independent third-party service providers including venues, couriers, transport providers, production companies, photographers, videographers, caterers, technology providers, security agencies, ticketing providers and media partners.
27.2 To the maximum extent permitted by law, the Organiser shall not be responsible for independent acts or omissions of such third parties outside the Organiser’s reasonable control.
28. PARTICIPANT CONDUCT AND EVENT SECURITY
28.1 Participants shall behave lawfully, respectfully and professionally.
28.2 The Organiser may refuse entry to or remove a Participant whose conduct is:
a. abusive;
b. threatening;
c. violent;
d. disruptive;
e. unsafe;
f. unlawful;
g. harassing; or
h. materially interfering with Event operations.
28.3 The Organiser may take reasonable measures to protect Participants, guests, staff, Sponsors, partners, vendors and property.
28.4 Removal from the Event shall not create an entitlement to compensation.
29. GOOD-FAITH PARTICIPATION AND MALAFIDE INTENT
29.1 Each Participant represents that the Participant is participating in good faith and for a legitimate purpose connected with the Awards.
29.2 A Participant shall not knowingly participate for the purpose of:
a. deceiving or misleading the Organiser;
b. obtaining an Award through false information;
c. obtaining promotional or commercial benefits through misrepresentation;
d. deliberately creating a false dispute;
e. damaging the reputation or goodwill of the Organiser through false or malicious conduct;
f. interfering with the Awards;
g. obtaining confidential information improperly;
h. manipulating the selection process;
i. improperly influencing the Organiser; or
j. accepting an Award while knowingly having no intention of complying with an accepted material Sponsor deliverable.
29.3 Where the Organiser reasonably determines that a Participant has materially abused the Awards process or acted in bad faith, the Organiser may suspend or terminate the Participant’s involvement, withdraw recognition where legally permissible, and exercise available legal or contractual remedies.
30. POST-EVENT CONDUCT AND NON-DISPARAGEMENT
30.1 The Participant acknowledges that operational issues may occasionally arise in connection with a live Event, including delays, changes, technical issues, transportation issues, seating changes, trophy availability, food-box availability and other logistical matters.
30.2 Participants are encouraged to communicate genuine concerns directly to the Organiser through official channels and provide the Organiser a reasonable opportunity to investigate and respond.
30.3 Nothing in these Terms prevents a Participant from making a genuine complaint, reporting unlawful conduct, obtaining legal advice or exercising a statutory or other legally protected right.
30.4 However, the Participant shall not knowingly publish, circulate or communicate materially false or fabricated statements presented as facts with the intention of damaging the reputation, goodwill or commercial interests of:
a. the Organiser;
b. the Awards;
c. the Event;
d. Organiser directors, officers, employees or representatives;
e. Sponsors;
f. partners;
g. media partners; or
h. other persons associated with the Awards.
30.5 This applies to communications through social media, websites, WhatsApp, messaging platforms, interviews, podcasts, print, television, digital media or any other medium.
30.6 A Participant shall not knowingly fabricate, manipulate or materially misrepresent Event-related information to create a false impression of misconduct by the Organiser.
30.7 Where materially false information concerning the Awards is published, the Organiser may issue a factual correction and preserve relevant records for legal and evidentiary purposes.
30.8 The Organiser reserves all legal and contractual remedies available in respect of actionable false, defamatory, fraudulent or malicious conduct.
31. NO FALSE CLAIMS AGAINST ORGANISER
31.1 A Participant shall not knowingly make false allegations presented as fact that the Organiser:
a. committed fraud;
b. manipulated the Award;
c. cheated the Participant;
d. misappropriated money;
e. demanded payment for the Award;
f. promised an Award in exchange for payment;
g. engaged in unlawful conduct; or
h. otherwise engaged in misconduct,
where the Participant knows the allegation to be false or materially misleading.
31.2 This clause does not prevent truthful statements, genuine complaints or lawful reporting.
32. HARASSMENT, THREATS AND INTIMIDATION
32.1 Participants shall not threaten, intimidate, harass, abuse or coerce the Organiser, its employees, representatives, Sponsors, partners, vendors or other Participants.
32.2 Such conduct includes conduct through:
a. telephone;
b. email;
c. WhatsApp;
d. social media;
e. messages;
f. third parties; or
g. other communication channels.
32.3 Nothing prevents a Participant from making a legitimate complaint or exercising a lawful remedy.
33. EVIDENCE AND RECORDS
33.1 The Organiser may retain reasonable records necessary to administer and protect the Awards, including:
a. nomination forms;
b. digital acceptance records;
c. emails;
d. WhatsApp communications;
e. submitted documents;
f. social-media links;
g. screenshots;
h. Event photographs;
i. Event recordings;
j. Sponsor communications;
k. deliverable records; and
l. other relevant records.
33.2 Such records may be retained for Award administration, legal, compliance, evidentiary, archival and dispute-resolution purposes, subject to applicable law.
34. INDEMNITY BY PARTICIPANT
34.1 To the maximum extent permitted by law, the Participant agrees to indemnify and hold harmless the Organiser, its directors, officers, employees, affiliates, agencies, contractors, Sponsors, partners and representatives against claims, liabilities, losses, costs and expenses arising from:
a. breach of these Terms;
b. breach of an accepted Sponsor deliverable;
c. false information;
d. infringement of intellectual-property rights;
e. unauthorised third-party material;
f. violation of privacy or publicity rights;
g. unlawful conduct;
h. fraudulent activity;
i. manipulated statistics;
j. Participant-created content;
k. Participant conduct; or
l. acts or omissions of persons acting on behalf of the Participant.
34.2 The indemnity includes reasonable legal and professional expenses to the extent permitted by applicable law.
35. LIMITATION OF LIABILITY
35.1 To the maximum extent permitted by applicable law, the Organiser shall not be liable for indirect, incidental, special, exemplary, punitive or consequential loss arising from participation in the Awards.
35.2 This includes, to the extent legally permissible:
a. loss of profits;
b. loss of business;
c. loss of commercial opportunity;
d. loss of anticipated sponsorship;
e. loss of followers;
f. loss of social-media engagement;
g. loss of reputation;
h. loss of anticipated publicity;
i. loss of income;
j. disappointment arising from non-winning; and
k. other consequential losses.
35.3 Nothing in these Terms excludes or restricts liability that cannot legally be excluded or restricted.
36. NO GUARANTEE OF COMMERCIAL BENEFIT
36.1 The Organiser does not guarantee that participation or winning an Award will result in:
a. increased followers;
b. increased reach;
c. increased revenue;
d. brand collaborations;
e. sponsorships;
f. media coverage;
g. business opportunities; or
h. any other commercial outcome.
36.2 The Participant acknowledges that such outcomes depend on factors outside the Organiser’s control.
37. PRIVACY AND PERSONAL DATA
37.1 The Organiser may collect and process personal information submitted through the nomination form for purposes including:
a. nomination administration;
b. eligibility verification;
c. communication;
d. Award administration;
e. Event management;
f. publicity and marketing where appropriately authorised; and
g. other legitimate Award-related purposes.
37.2 The Organiser shall process personal data in accordance with applicable data-protection law and its applicable Privacy Policy.
37.3 The Participant confirms that the information submitted is accurate and that the Participant has the necessary authority to submit it.
37.4 The Organiser may share necessary information with authorised service providers, Event agencies, technology providers, professional advisers and other persons where reasonably necessary for Award administration, subject to applicable law.
37.5 The Participant’s personal-data rights shall be governed by applicable data-protection law and the Organiser’s applicable Privacy Policy.
38. SOCIAL MEDIA AND OFFICIAL ANNOUNCEMENTS
38.1 Participants shall not represent themselves as Winners before an official announcement by the Organiser.
38.2 Winners may identify themselves as Winners after official announcement.
38.3 The Organiser may provide official Winner badges, graphics, logos or other promotional assets.
38.4 Such assets may be used only in accordance with the Organiser’s instructions.
38.5 Unauthorised use of the Awards branding may constitute infringement.
39. CONFIDENTIALITY
39.1 Participants shall maintain confidentiality regarding non-public information received from the Organiser concerning:
a. unpublished Winner information;
b. commercial arrangements;
c. Sponsor arrangements;
d. confidential communications;
e. Event security;
f. internal processes; and
g. other information expressly identified as confidential.
40. DISQUALIFICATION AND WITHDRAWAL OF AWARD
40.1 The Organiser may disqualify a Participant or withdraw recognition where permitted by law if the Organiser reasonably determines that the Participant has:
a. submitted false information;
b. materially misrepresented credentials;
c. manipulated metrics;
d. committed fraud;
e. infringed third-party rights;
f. materially breached these Terms;
g. materially abused the Awards process;
h. engaged in unlawful conduct; or
i. otherwise engaged in material misconduct connected with the Awards.
40.2 Where an Award is withdrawn, the Organiser may:
a. issue a correction;
b. amend its records;
c. remove promotional recognition where reasonably practicable;
d. declare another Winner; or
e. leave the Category without a Winner.
41. FUTURE EDITIONS
41.1 Nothing in these Terms guarantees participation in any future edition.
41.2 The Organiser may change future editions, including:
a. Categories;
b. eligibility;
c. selection methodology;
d. Event format;
e. venue;
f. Sponsors;
g. media partners; and
h. commercial arrangements.
41.3 A previous Winner shall not automatically be entitled to nomination or participation in a future edition.
42. FORCE MAJEURE
42.1 The Organiser shall not be responsible for delay, interruption or failure caused by circumstances beyond its reasonable control, including:
a. natural disasters;
b. governmental action;
c. public emergencies;
d. epidemic or pandemic;
e. fire;
f. flood;
g. civil disturbance;
h. war;
i. terrorism;
j. venue closure;
k. technical infrastructure failure;
l. power failure;
m. telecommunications failure;
n. transportation disruption;
o. security concerns; or
p. other force majeure circumstances.
43. AMENDMENT OF TERMS
43.1 The Organiser may amend these Terms where reasonably necessary.
43.2 The latest applicable version published on the official Awards website shall govern future participation, subject to applicable law.
43.3 Material changes shall be communicated through appropriate channels where required by law.
44. NO WAIVER
44.1 Failure by the Organiser to enforce any provision immediately shall not constitute a waiver of the Organiser’s right to enforce that provision subsequently.
45. SEVERABILITY
45.1 If any provision of these Terms is found invalid, unlawful or unenforceable, that provision shall be modified or severed only to the minimum extent necessary, and the remaining provisions shall continue to operate to the extent legally permissible.
46. ENTIRE AGREEMENT
46.1 These Terms, the nomination form, applicable Category requirements, specific Sponsor deliverable communications, Privacy Policy, Event rules and other documents expressly incorporated by the Organiser constitute the agreement governing participation.
46.2 Where a specific written Sponsor deliverable is communicated to and accepted by a Winner, such communication forms part of the Winner’s contractual obligations.
47. GOVERNING LAW
47.1 These Terms shall be governed by the laws of India.
48. DISPUTE RESOLUTION
48.1 The Participant shall first communicate any genuine contractual or administrative concern to the Organiser through its official contact channel and provide the Organiser a reasonable opportunity to address the matter.
48.2 Subject to applicable law, disputes arising from these Terms that are legally capable of being referred to arbitration shall be referred to arbitration under the Arbitration and Conciliation Act, 1996.
48.3 The arbitration shall be conducted by a sole arbitrator appointed in accordance with applicable law.
48.4 The seat of arbitration shall be Mumbai, Maharashtra, India.
48.5 The language of arbitration shall be English.
48.6 Nothing in this clause prevents a party from seeking urgent interim or protective relief from a competent court where legally available.
49. JURISDICTION
49.1 Subject to the arbitration provisions and applicable law, courts having competent jurisdiction in Mumbai, Maharashtra shall have jurisdiction over matters arising from these Terms.
50. ACCEPTANCE OF TERMS
By ticking the acceptance box and submitting the nomination form, the Participant confirms:
☐ I have read and understood these Terms & Conditions.
☐ I agree to be bound by these Terms & Conditions.
☐ I understand that participation and the Award are provided without an Award/participation fee.
☐ I understand that the Organiser exclusively determines the Award result.
☐ I understand that there is no Jury unless expressly announced by the Organiser.
☐ I understand that receiving an Award does not create an entitlement to any payment from the Organiser.
☐ I understand that Sponsor deliverables may be applicable to selected Winners.
☐ I agree that an accepted Sponsor deliverable constitutes a binding commitment.
☐ I understand that failure to perform an accepted Sponsor deliverable may result in a claim for ₹15,000 as agreed compensation, subject to applicable law.
☐ I consent to the Organiser’s use of photographs, videos, interviews, name, image, likeness and Award-related material as described in these Terms.
☐ I understand that such material may be used to promote future editions of the Awards.
☐ I acknowledge the Organiser’s ten-year media rights relating to the current edition.
☐ I understand that food boxes, hampers and complimentary items are strictly subject to availability and are distributed on a first-come, first-served basis unless otherwise stated.
☐ I understand that Event arrangements, trophy delivery, transportation and other operational matters may be affected by circumstances beyond the Organiser’s reasonable control.
☐ I agree to participate in good faith and not knowingly provide false or misleading information.
☐ I agree to comply with applicable Event rules and reasonable instructions.
☐ I understand the post-Event conduct and non-disparagement provisions contained in these Terms.
☐ I confirm that the information submitted by me is accurate and complete.
