Thane MACT awards Rs 16.48 lakh to Mumbai motorcyclist injured in 2018 accident

The Motor Accident Claims Tribunal (MACT) in Thane, Maharashtra, has awarded a compensation of Rs 16.48 lakh to a motorcycle rider who sustained grievous injuries after being hit by a car in Mumbai in 2018, news agency PTI reported.

The verdict was delivered by tribunal member Rupali V Mohite on Monday.

The petition was filed by the injured rider, Sarfaraz Abutalib Shaikh, who suffered a permanent partial disability in the accident. PTI reported. The incident occurred on the afternoon of May 5, 2018, on the Parel Bridge in Mumbai.

Shaikh, a DJ operator/event manager, who was then 38, was riding a motorcycle when a car driven rashly and negligently came from the opposite direction, jumped the road divider, and collided head-on with his motorcycle.

The impact was so severe that the pillion rider fell off the bridge, while Shaikh sustained grievous injuries, including multiple fractures.

The car occupants, identified as driver Vinayak Lotan Patil (Navi Mumbai) and Dinesh Ashok Gurnani (Mumbai), failed to file a written statement, resulting in the case proceeding ex parte against them, reported PTI.

The tribunal said, “As per the evidence on record, the offending car came towards the wrong side of the road by crossing the divider and gave a dash to the motorcycle of the claimant. The pillion rider on the motorcycle fell off the bridge. This shows the rashness and negligence of the car driver.”

The tribunal directed the car occupants to pay Rs 16,48,960 along with interest calculated at 9 per cent per annum from the date of the petition until the amount is deposited.

In a similar incident, the Motor Accident Claims Tribunal (MACT) in Thane awarded a compensation of Rs 25 lakh to the family of a man who died after being hit by a container truck in 2019, reported news agency PTI.

Thane MACT member Rupali V Mohite, in the order on November 20, directed the truck`s insurance company to pay the compensation initially, but granted the insurer the right to recover the full amount from the vehicle owner, citing a proven breach of policy conditions, reported PTI.

The victim, Md Muslim Shabbir Shaikh (then aged 34), who worked in a private company, was walking along the Mahape-Shilfata Road in Maharashtra`s Thane district on June 11, 2019, when a container truck allegedly speeding at a “high and uncontrollable” pace hit him from behind, reported PTI.

He suffered severe crush injuries and died six days later. His parents and two unmarried sisters, natives of Gonda in Uttar Pradesh, filed a claim seeking Rs 15 lakh.
